General terms and conditions

By accessing Muscreators and placing an order, you confirm that you agree to the terms of service contained in the following Terms and Conditions. These terms apply to the entire website and any email or other type of communication between you and Muscreators.

In no event shall Muscreators be liable for any direct, indirect, special, incidental, or consequential damages, including but not limited to loss of data or profits, arising out of the use of or the inability to use the materials on this site, even if Muscreators or a Muscreators authorised representative has been advised of the possibility of such damages.

Muscreators is not responsible for any consequences that may arise from the use of our resources. We reserve the right to change prices and revise our resource usage policy at any time.

Licence

Muscreators grants you a non-exclusive, non-transferable, access to use the Application solely in accordance with the terms of this Agreement.

These Terms and Conditions constitute a legal contract between you and Muscreators (referred to in these Terms and Conditions as ‘Muscreators’, ‘we’, ‘our’ or ‘us’), the provider of the Muscreators website and the services available through the Muscreators website (which are collectively referred to in these Terms and Conditions as the ‘Muscreators Service’).

You agree to be bound by these Terms and Conditions. If you do not agree to be bound by these Terms and Conditions, please do not use the Muscreators Service. In these Terms and Conditions, ‘you’ refers to you as an individual as well as to the legal entity in which you are acting. If you breach any of these Terms and Conditions, we reserve the right to cancel your account or block access to your account without notice.

In order to make the terms of this Agreement as clear as possible, whenever any of these terms are mentioned, they are strictly defined as follows:

Company: Whenever this policy refers to ‘Company,’ ‘we,’ ‘us’ or “we” refers to Muscreators, which is responsible for your information under this Agreement.

Country: where Muscreators or the owners/founders of Muscreators are located, in this case Ukraine.

Device: any device connected to the Internet, such as a phone, tablet, computer or other device, which can be used to visit Muscreators and use the Services.

Service: refers to the services provided by Muscreators as described in the relevant terms and conditions (if available) and on this platform.

Third Party Service: refers to advertisers, competition sponsors, promotional and marketing partners and others who provide our content or whose products and services we believe may be of interest to you.

You: the individual or legal entity that is registered with Muscreators to use the Services.

Restrictions

You agree not to do any of the following, nor to allow anyone else to do so:

Licence, sell, rent, lease, loan, redistribute, transfer, distribute, outsource, disclose or otherwise commercially exploit the application or provide access to the platform to any third party.

Modify, create derivative works from, disassemble, decipher, compile from source code or reverse engineer any part of the application.

Remove, modify or obscure any proprietary notices (including copyright or trademark notices) of Muscreators or its affiliates, partners, suppliers or licensors of the Application.

Return and refund policy

Thank you for shopping with Muscreators. We are grateful that you have enjoyed purchasing the products we have created. We also want you to have a positive experience when you research, evaluate, and purchase our services.

As with any shopping experience, the terms and conditions that apply to Muscreators transactions apply. By making a purchase from Muscreators, you agree to be bound by the terms and conditions as well as the Muscreators Privacy Policy.

If, for any reason, you are not completely satisfied with any product or service we provide, please do not hesitate to contact us and we will discuss any issues you are experiencing with our product.

Your suggestions

Any feedback, comment, idea, improvement or suggestion provided by you to Muscreators regarding the Application remains the sole property of Muscreators. Muscreators shall be free to use, copy, modify, publish or distribute the Suggestions for any purpose and in any manner without attribution or compensation to you.

These Terms and Conditions apply to the Services only. The Services may contain links to other websites that are not operated or controlled by Muscreators. We are not responsible for the content, accuracy or opinions expressed on such websites and such websites are not reviewed, monitored or verified for accuracy or completeness by us. Please remember that when you use a link to another website, our Terms and Conditions no longer apply. Your browsing and interaction on any other website, including those that have a link to our platform, is subject to that website's own terms and conditions and policies. Such third parties may use their own cookies or other methods to collect information about you.

Muscreators uses ‘cookies’ to identify the areas of our website that you have visited. A cookie is a small piece of data stored on your computer or mobile device by your web browser. We use cookies to improve the performance and functionality of our application. Most web browsers can be set to disable the use of cookies. However, if you disable cookies, you may not be able to access the functionality of our website correctly or at all. We never place personally identifiable information in cookies.

Changes to our Terms and Conditions

You agree and acknowledge that Muscreators may discontinue (temporarily or permanently) the provision of the Service (or any features within the Service) to you or to users generally, in Muscreators' sole discretion, without notice to you. You may discontinue using the Service at any time. You do not need to specifically notify Muscreators when you discontinue using the Service. You acknowledge and agree that if Muscreators disables access to your account, you may not be able to access the Service, your account information, or any files or other materials contained in your account.

If we decide to change our Terms and Conditions, we will post those changes on this page and/or update the date of the change to the Terms and Conditions below.

Changes to our app and updates

Muscreators reserves the right to modify, suspend or discontinue, temporarily or permanently, the Application or any service to which it connects, with or without prior notice and without liability to you.

From time to time, Muscreators may provide improvements or enhancements to the features or functionality of the Application, which may include patches, bug fixes, updates, upgrades and other modifications (‘Updates’).

Updates may modify or remove certain features and/or functionality of the Application. You agree that Muscreators has no obligation to provide any Updates or to continue to provide or enable any particular features and/or functionality of the Application to you.

You further agree that all Updates will be considered an integral part of the Application and will be subject to the terms of this Agreement.

Third party services

We may display, incorporate or make available third party content (including data, information, applications and other products and services) or provide links to third party websites or services (‘Third Party Services’).

You acknowledge and agree that Muscreators is not responsible for any Third Party Services, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect. Muscreators does not assume and shall not be responsible or liable to you or any other person or entity for any Third Party Services.

Third Party Services and links to them are provided solely as a convenience to you and you access and use them in their entirety at your own risk and are subject to the terms and conditions of such third party services.

Terms and termination

This Agreement will remain in effect until either you or Muscreators terminates it.

Muscreators may, in its sole discretion, at any time and under any circumstances, suspend or terminate this Agreement with or without notice.

This Agreement will terminate immediately, without prior notice from Muscreators, if you fail to comply with any provision of this Agreement. You may also terminate this Agreement by uninstalling the Application and all copies of it from your computer.

Upon termination of this Agreement, you must stop using the Application and delete all copies of the Application from your computer.

Termination of this Agreement will not limit any of Muscreators' rights or remedies at law or in equity in the event that you breach (during the term of this Agreement) any of your obligations under this Agreement.

Notification of copyright infringement

If you are a copyright owner or the copyright owner's agent and you believe that any material on our Application constitutes an infringement of your copyright, please contact us with the following information (a) a physical or electronic signature of the copyright owner or a person authorised to act on its behalf; (b) identification of the infringing material; (c) your contact information, including your address, telephone number and email address; and (d) a statement by you that you have a good faith belief that the use of the material is not authorised by the copyright owner.

Lack of guarantees

The Application is provided to you ‘AS IS’ and ‘AS IS’, with all faults and defects, without warranty of any kind. Muscreators, the owner of the Application, its affiliated companies, and their licensors and service providers disclaim all warranties of any kind, whether express, implied, statutory or otherwise, with respect to the Application. This includes all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, as well as warranties that may arise by course of dealing, performance, usage or trade practice.

Without limiting the foregoing, Muscreators makes no warranties or representations and makes no representations that the App will meet your requirements, achieve any particular results, or be compatible or work with any other software, systems or services. Muscreators also does not warrant that the Application will be uninterrupted, meet any performance or reliability standards, be error-free, or that any errors or defects will be corrected.
In view of the foregoing, neither Muscreators nor any Muscreators supplier makes any representations or warranties regarding the operation or availability of the app, the information, content and materials or products contained therein. Muscreators also does not warrant that the application will be uninterrupted or error-free. In addition, Muscreators is not responsible for the accuracy, reliability or currency of any information or content provided through the application. Muscreators also does not warrant that the application, its servers, content or emails sent on behalf of Muscreators will be free of viruses, scripts, Trojan horses, computer worms, malware, time bombs or other harmful components.

Limitation of liability

Notwithstanding any damages that you may suffer, the total liability of Muscreators and any of its suppliers under any term of this Agreement and your exclusive remedy for all of the above circumstances will be limited to the actual amount you actually paid for the application.
To the maximum extent permitted by applicable law, in no event shall Muscreators or its suppliers be liable for any special, incidental, consequential or indirect damages (including, but not limited to, loss of profits, loss of data or other information, business interruption, personal injury, loss of privacy, arising out of or related to the use of or inability to use the application, third party software and/or third party hardware, or otherwise in connection with the

Some states/jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Inability to apply certain provisions

If any provision of this Agreement is held to be unenforceable or invalid, such provision will be modified and interpreted to achieve the maximum extent possible the purposes of that provision under applicable law, and the remaining provisions will continue in full force and effect.

This Agreement, together with the Privacy Policy and all other legal notices published by Muscreators on the Services, constitutes the entire agreement between you and Muscreators with respect to the Services. In the event that any provision of this Agreement is held invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. No waiver of any provision of this Agreement shall be deemed a further or continuing waiver of such provision or any other provision, nor shall the failure of Muscreators to exercise any rights or remedies under this Agreement constitute a waiver of such rights or remedies.

YOU AND MUSCREATORS AGREE THAT ANY PROCEEDING AGAINST THE SERVICES, WHICH IS DETERMINED IN CONNECTION WITH THE SERVICES, MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE Cause of Action AROSES. OTHERWISE, SUCH CAUSE OF ACTION SHALL BE PERMANENTLY BARRED.

Disclaimer of the right

Except as otherwise provided in this Agreement, the failure to exercise a right or to perform an obligation under this Agreement shall not preclude a party from exercising such right or from requiring performance of an obligation at any time thereafter, and a waiver of a breach shall not constitute a waiver of any subsequent breach.

No failure by any party having rights or powers under this Agreement to exercise or delay in exercising any rights or powers under this Agreement shall be deemed a waiver of such rights or powers. Also, no single or partial exercise of any rights or powers under this Agreement shall prevent the further exercise of such rights or powers or any other rights granted hereunder. In the event of a conflict between this Agreement and any purchase agreements or other terms and conditions, the terms of this Agreement shall control.

Amendments to this Agreement

Muscreators reserves the right, at its sole discretion, to modify or replace this Agreement at any time. In the event of a material change, we will provide at least 30 days' prior notice before the new terms and conditions take effect. What is considered a material change will be determined in our sole discretion.

By continuing to access or use our app after any changes are in effect, you agree to be bound by the revised terms. If you do not agree to the new terms, you may not use Muscreators.

Entire Agreement and Updates

This Agreement constitutes the entire agreement between you and Muscreators with respect to your use of the Application and supersedes all prior written or oral agreements between you and Muscreators relating to the Application. You may also be subject to additional terms and conditions that apply when you use or purchase other Muscreators services, which Muscreators will provide to you at the time of such use or purchase.

We may change our services and policies, and we may need to change these Terms to accurately reflect our services and policies. Unless otherwise required by law, we will notify you (for example, through our services) before we change these Terms and give you an opportunity to review them before they become effective. After that, if you continue to use the service, you will be bound by the updated Terms. If you do not wish to agree to these or any updated Terms, you may cancel your account.

Intellectual property

The Programme and its entire content, functionality and features (including, but not limited to, all information, software, text, images, video and audio, as well as the design, selection and arrangement thereof), are the property of Muscreators, its licensors or other suppliers of such material and are protected by Ukrainian and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. The material may not be copied, modified, reproduced, uploaded or distributed in any way, in whole or in part, without the express prior written consent of Muscreators, except as set out in these Terms and Conditions. Any unauthorised use of the material is prohibited.

Other

If for any reason a court of competent jurisdiction finds any provision or part of these Terms and Conditions to be invalid, the remainder of the Terms and Conditions will remain in full force and effect. Any waiver of any of the Terms and Conditions will be effective only if signed in writing by an authorised representative of Muscreators. In the event of a breach or alleged breach by you, Muscreators will be entitled to injunctive or other equitable relief (without obligation to produce any accounts or collateral). Muscreators operates and controls the Muscreators Service from its offices in Ukraine. The Service is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be unlawful. Consequently, persons who choose to access the Muscreators Service from other locations do so at their own risk and are solely responsible for compliance with local laws, if and where applicable. These Terms and Conditions (which include and incorporate the Muscreators Privacy Policy) contain the entire agreement and supersede all prior agreements between you and Muscreators with respect to its subject matter and may not be modified or amended by you. Section headings used in this Agreement are for convenience only and will not have any legal effect.

Disclaimer of liability

Muscreators is not responsible for any content, code or other inaccuracies.

Muscreators makes no warranties or promises.

In no event shall Muscreators be liable for special, direct, indirect, consequential, incidental or exemplary damages, or any other damages, whether in contract, negligence or other tort, in connection with the use of the Service or the content of the Service. The Company reserves the right to add, remove or change content on the Service at any time without prior notice.
The Muscreators Service and its content are provided ‘as is’ and ‘as available’ without warranty or representation of any kind, either express or implied. Muscreators is a distributor, not a publisher, of content provided by third parties; therefore, Muscreators does not exercise editorial control over such content and makes no warranties or representations as to the accuracy, reliability or currency of any information, content, services or goods provided on or available through the Muscreators Service. Notwithstanding the foregoing, Muscreators disclaims all warranties and representations with respect to any content transmitted through the Muscreators Service or on sites that may appear as links on the Muscreators Service or to products provided as part of or otherwise connected with the Muscreators Service, including, without limitation, any warranties of fitness for a particular purpose, non-infringement, or non-infringement of third party rights. No oral or written advice given by Muscreators or any of its affiliates, employees, officers, directors, agents or other similar persons will create a warranty. Pricing and availability information is subject to change without notice. For the avoidance of doubt, Muscreators does not warrant that the Muscreators Service will be uninterrupted, uninterrupted, timely or error-free.
